5. Terms and Conditions of Sale

1. Seller Identification
These Terms and Conditions of Sale govern purchases made through this website, operated by GFlex Sàrl, whose registered office is located at Chemin des Pensionnats 2/6, 1700 Fribourg, Switzerland. Contact: support@gelflex-ca.com.

2. Purpose
These Terms and Conditions define the rights and obligations of the parties in connection with the online sale of GEL FLEX products to Canadian customers, including the GEL FLEX Lumbar Support Cushion.

3. Products and Prices
Prices are displayed in Canadian dollars (CAD). Any applicable taxes, where required, are displayed at checkout before the order is confirmed. GEL FLEX reserves the right to modify its prices at any time; the applicable price is the price displayed at the time the order is confirmed.

4. Orders
An order becomes final only after payment has been successfully confirmed. A confirmation email containing the order details and the total amount paid will be sent to the email address provided by the customer. GEL FLEX reserves the right to cancel or refuse any order in the event of a previous dispute, suspected fraud, or supply issues. In such cases, the customer will receive a full refund.

5. Payment
Payment is made online at the time of purchase using the payment methods available on the website. Transactions are secured and encrypted using SSL technology.

6. Shipping
Please refer to our Shipping Policy. Standard shipping is free throughout Canada. Any delivery times provided are estimates and do not constitute a guaranteed delivery date.

7. Returns and Refunds
Please refer to our Return & Refund Policy, which provides for a 30-day “Satisfaction Guaranteed or Your Money Back” commercial guarantee.

8. Warranty
Products sold are covered by the legal warranties provided under the Quebec Consumer Protection Act and the applicable laws in the province where the customer resides, including warranties relating to quality and normal use. In the event of a confirmed defect that is not caused by improper use, the customer may request repair, replacement, or a refund of the product.

9. Liability and Product Use
GEL FLEX products are intended for comfort purposes. They are not medical devices and do not replace the advice, diagnosis, or treatment provided by a healthcare professional. GEL FLEX shall not be held responsible for any damage resulting from use that is inconsistent with the intended purpose of the product or the instructions provided.

10. Intellectual Property
All content on this website, including text, images, logos, and the GEL FLEX trademark, is the exclusive property of GFlex Sàrl and may not be reproduced without prior authorization.

12. Language
These Terms and Conditions are written in French. French is the reference language for any interpretation of these Terms and Conditions.

13. Applicable Law
As the seller is established in Switzerland, these Terms and Conditions are governed by Swiss law. However, this clause shall not have the effect of depriving consumers residing in Quebec or another Canadian province of the protection afforded to them by the mandatory provisions of the laws of their province of residence, including the Quebec Consumer Protection Act. Quebec consumers retain the right to bring legal proceedings before the courts of their place of residence.
